The Spelinspektionen, the Swedish Gambling Authority, has released a consultation response regarding the proposed extension of the credit ban in the Gambling Act. This initiative aims to curb the ability of individuals to take out loans to sustain their gambling habits and prevent the use of credit for betting purposes. As part of this effort, the Spelinspektionen is considering the prohibition of using credit cards on gambling websites.
The Regulatory Stance:
Camilla Rosenberg, Director General of the Spelinspektionen, highlighted that licensees are obligated to ensure that players are not encouraged to take out loans to support their gambling activities, as it contravenes the duty of care defined in Chapter 14, Section 1 of the Gambling Act (2018:1138). The authority asserts that license holders are already prohibited from promoting or facilitating credit for wagering. However, it acknowledges the need to clarify this legal position in the text.
Current Decision and Future Investigations:
At present, the Spelinspektionen has decided against introducing a ban on credit card use for gambling. Instead, it plans to continue assessing the effectiveness of such bans in countries like the UK and Norway. Out of the 50 operators surveyed by the Authority, 60% confirmed that they currently offer credit cards as a payment method on their platforms.
The Debt and Credit Register:
While the ban on credit card use remains under review, the Spelinspektionen is certain about the introduction of a debt and credit register (Skri Register). This register is expected to play a crucial role in promoting responsible gambling and preventing players from accumulating unmanageable debts.
The Spelinspektionen’s considerations regarding the credit ban and credit card use in gambling reflect a commitment to protect players from the potential financial harm associated with excessive wagering.
