The Victorian government in Australia has unveiled a series of measures aimed at protecting consumers from gambling-related harm and promoting responsible gambling practices in the state. The initiatives, outlined in a Ministerial Direction, will be applicable to interstate wagering service providers offering interactive betting services to Victorians, as well as licensed betting service providers in Victoria catering to customers from any jurisdiction.
Phased Implementation of Measures:
The new regulations will be implemented in a phased manner, with the first set of requirements taking effect on July 31. From this date, wagering service providers must furnish monthly activity statements to all customers, with the previous month’s statement available upon request or through their online betting accounts. Additionally, customers should have access to their betting account transaction records, either immediately or within 14 days of their request.
Extensions for Compliance:
Wagering service providers unable to meet these requirements by the end of July may apply for an extension until November 14, provided they have valid reasons such as business disruptions caused by the Covid-19 pandemic.
Responsible Service of Wagering Training:
Starting from March 31, 2023, wagering service providers must ensure that all relevant personnel, including employees, contractors, and directors involved in providing betting services or making decisions affecting the services, complete responsible service of wagering training courses. Existing staff associated with the business by February 28, 2023, must complete initial training by March 31, 2023. New staff members should undergo initial training within one month of commencing employment. Additionally, all covered personnel must participate in annual refresher training within 12 months of completing the initial training and subsequently every year. Records of training must be retained for at least seven years, with the Victoria Gambling and Casino Control Commission (VGCCC) authorized to request copies.
Restrictions on Direct Marketing:
As of June 30, 2023, wagering service providers must allow new customers to create betting accounts without requiring consent for direct marketing or imposing additional steps to opt out of receiving such marketing communications.
